As a result, it's important to consider the implications of AI on privacy and take proactive steps to protect our personal information. This exciting technology is already being utilized in both the private and public sectors, taking advantage of data to enhance forecasting, improve products and services, save costs, and liberate employees from repetitive administrative tasks.
As with any new technology, there are always risks involved. The extensive and unregulated use of this technology raises concerns about its impact on human rights and personal privacy. This is particularly true for Generative AI (GenAI), which uses deep-learning algorithms and powerful foundation models to train on massive amounts of unlabeled data to produce output generated by artificial intelligence.
Let's explore the five essential steps that companies can take to establish trust in AI.
Understand Your Regulatory Landscapes and Implement an AI Privacy Strategy
Lawmakers, policymakers, and regulators have emphasized the importance of aligning AI systems with established standards. Therefore, it is crucial to identify the regulatory frameworks that apply to your business, determine which ones you will comply with, and plan how your AI will be deployed. It is crucial to establish an AI usage baseline that complies with different regulations and to streamline your AI development or business activities accordingly.
Integrate Privacy by Design Principles into Your AI Projects
It is important to evaluate how an AI system will affect privacy and ensure compliance with relevant regulations from the beginning and throughout its life cycle. This can be achieved by conducting a Privacy Impact Assessment (PIA) or Data Protection Impact Assessment (DPIA) in a systematic manner. The ISO 31700 Privacy by Design Standard provides guidelines for incorporating privacy considerations into the development of AI systems.
It's important to keep in mind that privacy risks can arise even if you believe that your system only uses anonymized or non-personal data. These risks can include re-identification from training data sets, as well as downstream impacts of non-personal data that's used to train models that impact individuals and communities. To ensure that your system is safe and secure, you should conduct a thorough assessment that also includes security and privacy threat modeling across the AI lifecycle.
You should also consult with stakeholders where appropriate. Finally, when considering privacy issues, it's important to take into account broader issues such as data justice (ensuring that people are treated fairly in the way their data is used) and indigenous data sovereignty (acknowledging the rights of indigenous peoples to govern data about their communities, peoples, lands, and resources).
Evaluate Privacy Risks Associated with AI
It's important to evaluate the potential risks to privacy when developing AI solutions in-house or using public models that train on public data. It's crucial to ensure that these models comply with the latest ethical and AI standards, regulations, best practices, and codes of conduct in order to meet the requirements (e.g. NIST, ISO, regulatory guidance). This applies to developers as well as clients who are developing, acquiring, and integrating AI systems. If you're a client, it is important to request from the developer the documentation supporting their Privacy Impact Assessment (PIA) and related AI privacy risk assessments.
You should also conduct your own private models. If the developer can't provide this documentation, it's best to consider another provider. In many jurisdictions, including the UK and the EU, a Privacy Impact Assessment (PIA) / Data Protection Impact Assessment (DPIA) is already a legal requirement and a baseline that should take AI considerations into account. The PIA/DPIA should cover the initial AI use and design considerations, such as problem statement, no-go zones, etc. Pay attention to the justification for the data collection, as well as the necessity and proportionality of such collection, as well as consent.
Audit your AI system
If you are involved in developing AI systems or providing AI services as a third party/vendor, it is important to ensure that your clients and regulatory bodies are confident in the reliability of your AI. One effective way to do this is by conducting an audit against recognized standards, regulatory frameworks, and best practices, including an algorithmic impact assessment.
To ensure the effectiveness, reliability, and fairness of an AI system, it is important to test it using scripts that simulate real-world scenarios. This testing should be done to gain user feedback and ensure that the system is accepted by users before deployment. It is also important to clearly explain the data used and how it was applied to the end-user. Additionally, end-users should be provided with an opportunity to contest or challenge the use of AI for automated decision-making purposes to prevent biased outcomes.
Respect everyone's rights and choices via explainability and transparency regarding data inputs and outputs
Ensure that the rights and choices of individuals are respected by providing clear explanations and transparent information about the data inputs and outputs of AI systems. Be prepared to manage the preferences of those who are affected by the development or use of such systems, and be ready to answer any questions they may have. Organizations that plan to use AI for automated decision-making should be able to explain in simple language how this technology can impact their end-users.
Explainability refers to the ability to explain why an AI system arrived at a particular decision, recommendation or prediction. It is important to be prepared to answer questions and address the concerns of individuals affected by the development or use of AI systems. You should consider documenting workflows that outline what data was used, how it was applied to the end user, and how the end user can challenge the use of AI for decision-making purposes, if necessary.
