Being able to grow efficiently without compromising your quality or profitability, so it is important to identify scalable business practices and incorporate them into your business model so that you are able to grow your business.

A crucial step in legitimizing your business is first, choosing a unique business name that is not in use by another entity, registering it and obtaining whatever required licenses, if any, are needed.?

If you have any desire of someday selling your business, I strongly suggest that you choose a business name that IS NOT your name. These days establishing a strong personal brand is extremely important and can make the difference in the success of your business, but that does not mean that your business needs your name. Some of the strongest personal brands come from the likes of Elon Musk, Richard Branson, Jeff Bezos, Donald Trump and Tony Robbins.? If, or when, any of the first three want to separate themselves from their businesses (Tesla, Virgin, Amazon) the task will be easy and lucrative.? On the other hand, Trump and Robbins have businesses in their name.? They can sell the assets of the business, but that’s about it because the business brand and personal brand are too closely tied together, limiting the value to others.?

To ensure your business name is unique, start by searching online business directories, social media platforms, and domain registration websites. Even if a domain has been purchased, check trademark databases to determine if your desired business name has already been registered, an essential step for avoiding potential legal disputes.

Finally, check with the database of business entities that has jurisdiction over business entities in your area.

Even after registering the business name, it's essential to monitor for any new businesses or trademarks that may infringe on the name. Regularly check trademark databases and online directories to identify any potential conflicts.

By following these steps and ensuring that the chosen business name is unique and legally available, entrepreneurs can mitigate the risk of legal disputes, establish a distinct brand identity, and build credibility with customers.

Choose The Right Business Structure

Selecting the appropriate business structure is a foundational decision for entrepreneurs, influencing legal, financial, and operational aspects of the business.?

Too often I see entrepreneurs make the basic mistake of simply setting up an LLC in their home state without any understanding of why.? Just because one lives in, let’s say, California, it does not mean they need to have their business located there. California happens to be a high tax state so why register there when you are free to choose one of several low-tax locations for your business?? Preserve your earnings for yourself!

LLCs, LLPs, sole proprietorships, and corporations are all common business structures to consider. Each has its own advantages and disadvantages concerning taxation, liability, and operational flexibility. What will best serve you is finding a tax accountant that specializes in your type of business.? They can provide a comparative analysis so that you can make informed decisions based on your unique needs and circumstances.

Registering Your Business Entity

Once you have found the right name and business structure, registering your business entity is a simple procedural task that varies depending on the jurisdiction and business structure. In the U.S. this starts with the TIN (taxpayer id number).? If your business is a sole proprietorship, you’ll be using your SSN number.? But if you want to separate your personal and business assets and add layers of legal protection, you’ll need an EIN (Employer Identification Number).?

Ensure Regulatory Compliance for Your Digital Presence

As you embark on your journey of starting a business, it's crucial to understand the legal requirements and obligations.?

In today's digital landscape, regardless of your type of business, its more than likely that you will have some sort of online presence.? If anything you do collects personal identifiable information (name, email, phone or other info) or engages in any ecommerce, it is imperative that you maintain compliance with regulatory standards.?

This begins with understanding and adhering to regulatory frameworks such as the Eurpoean Union’s General Data Protection Regulation (GDPR) and in the U.S., the Federal Trade Commission (FTC). By staying informed about these regulations, you can safeguard your business, mitigate legal risks, and maintain ethical standards.

Crafting robust compliance documents is not only a regulatory necessity but also a strategic step towards building credibility and trust with customers. By addressing key areas such as data privacy, terms of service, and refund policies, businesses can demonstrate their commitment to transparency and accountability.

A common mistake that I frequently must address with entrepreneurs is the Privacy Policy. This policy is a legal requirement to engage in most marketing activities but often is ignored as a necessity.? More often than not, I find a “Privacy Policy” link that goes nowhere, or when it does it is a policy that has either been copied/pasted from another source or has not been updated to reflect the frequent changes in regulations. Similarly, many businesses also avoid publishing a variety of other necessary legal policies.? Sometimes this is a result of lack of knowledge, and other times it's because of the perceived costs.? The costs can be excessive if enlisting the services of an attorney, but other less costly options exist.??

I strongly advise against using most free templates that are available online, as they often are not current with prevailing regulations.? The better option is from cloud-based services that dynamically update your policies as regulations change.

Necessary Documents

Privacy Statement

It is essential that a dynamic Privacy Statement outlines how your business collects, uses, and protects customer information in accordance with all of the jurisdictions where you may operate. This document should clearly communicate the company's data handling practices, including data storage, security measures, and third-party disclosures. By providing transparency regarding data processing activities, your business can foster trust and mitigate potential privacy risks.??

Terms & Conditions

Terms & Conditions serve as the legal framework governing the relationship between your business and your customers. These terms outline the rights and responsibilities of both parties regarding product/service delivery, payment terms, warranties, and dispute resolution mechanisms. By clearly defining these terms, your business can minimize legal disputes and ensure a smooth customer experience.

Disclaimers

Disclaimers are also critical for limiting your liability and managing customer expectations. Whether it's a disclaimer regarding the accuracy of information provided on your website or the performance limitations of whatever product or service you offer, You need to clearly communicate any potential risks or limitations. This proactive approach can help mitigate legal risks and protect your business from potential lawsuits.

Cookie Policy

In the realm of online commerce, Cookie Policies are also essential for informing users about the use of cookies and tracking technologies on the website. These policies explain how a “cookie” (a small data element) is used to track and record information about a user. Cookies are used for analytics, advertising, and personalization purposes, and allow users to make informed decisions about their privacy preferences. By complying with cookie consent regulations, your business can enhance user trust and avoid regulatory penalties.

Refund/Return Policies

Return/Refund Policies outline the procedures and conditions for returning or refunding the products and/or services you offer for purchase. These policies should address key aspects such as eligibility criteria, return shipping costs, restocking fees, and refund processing times.
