This includes transfer documents and other paperwork required by law to finalise the transaction. On occasion, they can draw up a Contract (if required), although this is usually the role of the Real Estate Agent.??

Title searches and investigations

To ensure that the property is free from any encumbrances, liens, or legal issues, Settlement Agents conduct thorough Title searches. This involves reviewing public records to confirm the property's ownership history, any outstanding mortgages or liens, and any other legal issues that could affect the transaction. This step is crucial to confirm that the seller has the legal right to sell the property and that no hidden surprises could affect the transaction.

Liaison and coordination

Acting as the primary point of contact, Settlement Agents coordinate with all parties involved in the transaction, including buyers, sellers, Real Estate Agents, Mortgage Brokers, and financial institutions. This ensures clear communication and helps address any issues promptly.

Financial calculations and adjustments

Settlement Agents are responsible for calculating the final settlement figures, including adjustments for rates and taxes. This involves reviewing land tax, water and council rates (and strata levies if applicable) and ensuring that these amounts are correctly adjusted and any outstanding amounts are paid at settlement.

Compliance with legal requirements

A core responsibility is to ensure that the transaction complies with all legal and regulatory requirements. Settlement Agents keep up-to-date with property law and regulations changes to protect their client's interests, providing a sense of security in an otherwise complex process.
