Ensuring Safety and Compliance in Labor-Hire Arrangements

Growing up riding quad bikes, I developed a deep appreciation for the thrill and risks associated with their use (have fallen off from basic mistakes). Couple that with my experience in labor hire as a recruitment consultant provided me with a comprehensive understanding of the complexities in ensuring labor-hire worker safety. Now, as the principal consultant of The Safety Team, I am dedicated to supporting organizations in navigating these challenges.

Recently, a significant legal case highlighted the critical importance of consultation between host employers and labor-hire companies. A court convicted and fined a host employer for failing to consult a labor-hire company, leading to a serious injury sustained by a labor-hire worker in a quad-bike rollover. This incident underscores the necessity for diligent safety practices and thorough communication.

The case involved NSW Central Tablelands vineyard operator Integrated Agricultural Developments Pty Ltd (IAD), which had engaged a labor-hire worker to monitor a controlled hazard reduction burn. Unfortunately, the worker suffered severe injuries due to inadequate safety measures and lack of consultation between IAD and the labor-hire company.

I wanted to share some key lessons learnt/actions that your organization could take when working with labor hire teams.


Key Lessons and Actions for Organizations

1. Verify Worker Competencies:

  • Ensure labor-hire workers have the necessary qualifications, licenses, and training to perform the work safely.

2. Consult on WHS Matters:

  • Engage in thorough consultations with the labor-hire company on work health and safety (WHS) matters, including the provision of equipment such as PPE.

3. Provide Comprehensive Inductions:

  • Ensure site-specific and task-specific inductions, training, and PPE are suitable, adequate, and readily understandable to labor-hire workers.

4. Establish and Enforce Safety Procedures:

  • Develop and enforce safety procedures for operating equipment, such as quad bikes, including installing operator protection devices and establishing exclusion zones.

5. Maintain Ongoing Communication:

  • Continuously communicate and coordinate with labor-hire companies to ensure all health and safety measures are up to date and adhered to.

Reflecting on Personal Experience

My own experiences growing up riding quad bikes and working in labor hire have given me a unique perspective on the need for rigorous safety standards. By implementing actions like verifying worker competencies, consulting on WHS matters, providing comprehensive inductions, and maintaining ongoing communication, organizations can create safer work environments.

The recent case involving IAD serves as a reminder of the consequences of failing to prioritize safety and communication. Let's work together to create safer workplaces and protect the health and safety of our labor-hire workforce.

Great info and topic Alanna - health monitoring is also an important risk that needs to be communicated to labour hire companies so they can coordinate any required HAZCHEM medicals. All about collaboration between the host and labour hire organisations and working together to keep workers safe
