New Coal Mining Safety and Health Legislation Amendment

The State Government has introduced the Coal Mining Safety and Health and Other Legislation Amendment Bill 2022 in response to several key reviews and inquiries, including the Brady Review and the Coal Mining Board of Inquiry following the Grosvenor coal mine explosion. This legislation seeks to reform mining safety standards and includes feedback from industry-wide safety resets.

One of the central amendments proposed in the bill is related to the employment conditions of statutory officeholders at coal mines. Specifically, the bill outlines conditions under which exceptions to direct employment requirements might be allowed, addressing corporate and operational structures, and the economic viability of operations. The intent is to allow more flexibility in how statutory roles such as Site Senior Executives and Mine Managers are filled, potentially using contractors, which has been a point of contention and concern regarding the independence and efficacy of these roles in maintaining safety standards.

Furthermore, the bill also includes amendments to several other resources acts, such as implementing a framework to defer rent for specific critical minerals mining leases and adjusting compliance provisions across various resources legislation.?
