Can engineers charge fees based on a percent of the construction contract to clients? is this legal or lawful? is there a conflict of interest with the client, since the engineer's fee is based on the amount of the contractor's Bid price, and what about if the engineer has the responsibility to help the client in choosing a contractor based on a bid price, would the engineer pick the cheapest price or the most expensive price? would the engineer have the client's best interest in mind or his own pocket? is this ethical?

9 年My plans this year is to conduct a seminar (live) to illustrate how the engineers ethical rules are enforced or negated in the practice of engineering and to discuss actual case studies outlining how to apply the rules and how they apply to practicing engineers. By a show of posts let me know us this subject is important to you and why. How engineers compete and how proposals and contracts are written . Any feedback will be appreciated.

9 年Daniel Can you please elaborate on what your response is? It appears what you stated is general in nature but can you explain why you have such a stand or position ? Why ?

9 年It show a very clear sign of conflict of interest and should not be used as an expert in court to validate a subject. a neutral outsider will be a better choice.

9 年Question : can an engineer work for a client on one job and another client on another job, say clients A and B? If client A is suing client B? Let's say the engineer is hired by client A as an expert witness, did a report and submitted the report to Vlient A with opinions and conclusions, can client B hire the same engineer as sn expert ? For the same report, job or case , why and why not?

9 年Reference ethical rules by NSPE , And other orifessional organizations. If you disagree then please provide examples., if you agree also provide examples and reasons why? Would you change your fee schedule to reflect a percent if contractor cost or contractor invoices? Why and why not?
