Engineering and Architectural Licenses are required whenever a firm or individual bids or offers services in a state. All necessary license requirements must be met before advertising, bidding, submitting proposals, or providing engineering services in any state. In most cases, you are not even permitted to use the word architect or engineer in a business name without being licensed there.
The first step of licensing is applying for individual professional engineer and/or architect licenses. In all fifty states, engineering and architect firms must have a licensed engineer or architect on staff. This licensed engineer or architect will be the engineer or architect in responsible charge for the firm’s license.
The second step of licensing is registering the business entity with the state through its secretary of state office. The state will issue a registration certificate (articles of incorporation, certificate of authority, etc.) approving your firm to transact business. As part of registering with the secretary of state, firms must appoint a registered agent to receive legal notices and other important documents.
The last step is applying for firm licensing that is administered by state engineering or architect boards. These firm licenses are usually called certificates of authorization. Wherever firm licenses are required, the firm must appoint a licensed engineer or architect in charge of the firm’s services. The firm license is contingent upon the individual architect or engineer’s license. If the individual’s license lapses, then the firm license is no longer valid.
