In the dynamic realm of law enforcement, Artificial Intelligence (AI) has emerged as a transformative tool, able to reshape policing strategies globally.
The surge in data generated by digital devices and online services, coupled with the intricate nature of modern criminal activities, underscores the inadequacy of traditional policing methods. For instance, investigations involving digital evidence, like those against crypto service providers such as Sky ECC and Encrochat , highlight the utility of AI-powered tools. Without such tools, the sheer volume of data could overwhelm investigators, significantly delaying processes and prosecution of criminals.
Globalization has further complicated law enforcement efforts, with cyber threats, cross-border trafficking, and international terrorism necessitating advanced and innovative solutions. In this context, AI presents a promising alternative by automating basic data pre-processing tasks, allowing human analysts to focus on more cognitive aspects of their work.
However, as AI gains prominence, concerns about its ethical, legal, and societal implications come to the forefront. The European Commission's proposal for an Artificial Intelligence Act (AI Act) seeks to regulate AI usage, ensuring alignment with fundamental rights and societal values. Emphasizing accountability and transparency, the AI Act aims to fortify democratic principles and maintain public trust in law enforcement actions.
Accountability serves as the bedrock of trustworthiness for security within our communities. In law enforcement, it defines the reliability of actions undertaken by the police, reinforcing public confidence. Transparency is equally vital, requiring stakeholders—from the public and policymakers to law enforcement officers and management—to understand how AI systems operate, manage data, and make decisions.
Together, accountability and transparency contribute to building trust, reassuring communities about the ethical deployment of AI in accordance with democratic and ethical standards. While the AI Act provides a comprehensive framework, it introduces challenges such as the conformity assessment of future AI systems. LEAs must ensure that AI tools adhere to ethical, legal, and human rights benchmarks while respecting individual freedoms and upholding public trust.
In addition to these principles, the explainability of AI system outputs is paramount, especially in crucial sectors like policing. Law enforcement agencies must adopt the latest methods developed by the scientific community to elucidate AI system conclusions. Failing to do so may undermine the entire criminal justice system in the future, emphasizing the urgency of embracing transparency and accountability in the integration of AI within law enforcement.
One notable effort in this direction is the Accountability Principles for Artificial Intelligence (AP4AI ) project, a collaborative initiative involving Europol, CENTRIC , and other EU Justice and Home Affairs (JHA) agencies, including the Fundamental Rights Agency (FRA), Eurojust, CEPOL, and Eu-LISA within the framework of the EU Innovation Hub for Internal Security .

The AP4AI project introduces a robust framework encompassing empirically validated accountability principles to guide internal security practitioners in the implementation of AI tools in compliance with ethical and legal standards. Breaking down these principles into actionable activities and steps, the framework ensures harmonization with the EU's core values and fundamental rights.
Published in late October, the AP4AI's International Citizen Consultation report provides valuable insights into public perceptions of AI use by law enforcement. The survey, conducted in 30 countries, including all 27 EU Member States, the USA, UK, and Australia, reflects a consensus among participants that the police should be held accountable for AI use and its consequences. Furthermore, areas with strong public support for AI utilization include the protection of children and vulnerable groups, the identification of criminals and criminal organizations, and the prediction of crimes before they occur.
Beyond the 12 accountability principles, AP4AI introduces an innovative tool—the Compliance Checker for AI (CC4AI )—designed to assist EU internal security practitioners in meeting the requirements of the upcoming AI Act. This step-by-step guidance allows users to assess whether existing or future AI applications in policing align with the new regulatory framework.
The AP4AI Framework, encapsulated by the CC4AI tool, extends beyond being a mere set of guidelines. It embodies the commitment of the EU's internal security community to balance the potential of AI with principles of accountability, transparency, and the protection of fundamental rights.
