Economic Loss Doctrine Decision
Economic Loss Rule Case
In the case captioned District of Columbia Water and Sewer Authority ("DC Water") brought suit against Samaha Associates, PC ("Samaha"), Adtek Engineers, Inc., and ECS Mid-Atlantic, LLC, seeking compensatory damages related to the Defendants' assessment of environmental conditions on a property DC Water acquired. ECF 30 (First Amended Complaint) If 1. Subsequently, Cross-Plaintiff, Adtek Engineers, Inc. ("Adtek"), sued Cross-Defendant ECS Mid-Atlantic, LLC ("ECS"). The Court found that the Economic Loss Rule barred the Architect’s claim against its consultants, who did not owe any tort duty to the architect’s client.? Check your jurisdiction, because where it applies the economic loss rule is a powerful tool for design professionals.
