EBRS Heat Network Notification Requirement - Deadline 6 January 2023

In November we wrote to you about the Energy Bill Relief Scheme (EBRS) pass-through requirements for heat networks. A PDF copy can be found and downloaded?here.

Since our last article, the government has announced a requirement for all heat networks to be registered with the Department for Business, Energy and Industrial Strategy (BEIS).

The official announcement reads:

To support the delivery of the Energy Bill Relief Scheme, the Government is requiring all heat suppliers to provide information about the heat network(s) they operate.

This will involve submitting your name, business address and contact details in the Heat Networks Energy Bill Relief Scheme (EBRS) pass-through notification form.

This information is needed to support the delivery of the investigation and resolution of customer complaints by the Energy Ombudsman and the General Consumer Council for Northern Ireland (CCNI). Heat suppliers are asked to complete the webform by 6 January 2023 to ensure that their details are up to date.


NEXT STEPS


We would like to highlight that the registration deadline is 6 January 2023. We appreciate this is tight, and urge all affected clients to take appropriate action as soon as possible.

Under the requirements, each heat network must be registered by the Heat Supplier, by completing the following form:

Heat Networks Energy Bill Relief Scheme (EBRS) Pass-through Notification Form

This form is limited to just one page and should only take a couple of minutes to complete. The following details are required:

  • Heat Supplier Details (name, address, contact details, company reg, type of organisation)
  • Heat Network Details (site name, postcode, communal or district network, confirmation that the Heat Network notification form has been submitted under the Heat Regs 2014)

To be clear, this notification is part of the EBRS pass-through requirement for heat networks.

This is separate from the notification requirement under the Heat Network (Metering and Billing) Regulations 2014, whereby a Heat Supplier must submit an initial notification to the Office for Product Safety and Standards (OPSS) on/before the day a heat network becomes operational.

DEFINING THE HEAT SUPPLIER


The Heat Supplier is the legal entity that supplies and charges for the supply of heat and/or hot water to a final customer through a heat network. In most cases, this will be the entity that has a Lease Agreement (and/or Heat Supply Agreement) with the customer, generally the building Freeholder.

If you are a Managing Agent and you manage a development with a Heat Network, you will likely have a responsibility on behalf of your client (the Heat Supplier) to ensure that they are fully compliant with regulations.

Similarly, if you are responsible for settling the communal fuel (typically gas) invoices for a building or development, then in all likelihood you are acting on behalf of the Heat Supplier and will need to complete the Pass-Thorough Notification Form on their behalf.
