During this COVID time, people have switched to purchasing commodities online instead of offline purchasing and they have started purchasing and buying commodities through e-commerce sites.
E-commerce web portals are giving a wide range of choices and also it is less time-consuming in comparison to buying commodities offline, but it is also bringing more risk with it, which is ultimately increasing the number of legal metrology disputes in E-commerce web portals.
That is why LMPC Act laid down certain rules and regulations which are to be followed by the E-commerce sites or e-commerce web portals while dealing in commodities in the Indian market.??
There are various compliance that have to be done by e-commerce sites to protect themselves from legal metrology disputes. E-commerce sites or e-commerce web portals should have the following declarations:?
- E-commerce sites must have the details of the manufacturer and importer.?
- It should have the proper details of the commodity which is to be sold in the Indian market.?
- Proper details in regards to the MRP should be disclosed on the e-commerce web portal, which should be inclusive of all the taxes.?
- It should have the country of origin of the commodity and other related information.?
- The site should have the details of the seller, importer, packer, and manufacturer.?
- E-commerce sites or companies should ensure the declarations on digital or electronic platforms are in accordance with rule 10 of the act.?
- The e-commerce web portal must disclose the information in both electronic form and digital form in order to facilitate communication in a better way between the seller and the buyer.?
- All the products which are sold by the e-commerce sites on its platform should fall under the category of prepacked commodities.?
- If any e-commerce web portal faces any kind of legal issue, it should immediately take the help of a legal metrology advocate or a legal metrology expert to resolve the issue.?
- If any notice is received by the e-commerce portal in regards to the legal metrology dispute, in case they have committed the non-compliance of the act, then they should immediately rectify their mistake?
- By making the proper compliance with the Act E-commerce web portal can protect itself from the consumer complaint or report to the legal metrology officer, in order to prevent themselves from future hurdles in their business and to deal in the Indian market compliances should be ensured by the e-commerce sites.?
- Every e-commerce web portal must go through legal metrology compliance which is to be done by them thoroughly prior to starting their business. They must get the appropriate registration to start their business in the Indian market and should make the proper declarations in compliance with the act.?
Any person who has committed an offense by conducting a contradiction with the rules and regulations of the legal metrology act can be summoned by the legal metrology officer.
Such a person has to appear before the concerned authority and must give a valid reason and ensure such conduct will not take place in the future, if the competent authority may think fit then might give a chance to the e-commerce web portal.
