1) Is your employee currently exempt from overtime now?
No = No actions required
Yes = Continue
2) Does the employee meet the duties test based on current FLSA law (administrative, executive, or professional position)?
No = Reclassify as non-exempt and pay overtime for over 40 hours a week.
Yes = Continue
3) Does the employee earn $913 gross pay per week?
Yes = No action required
No = Reclassify employee and pay them for overtime over 40 hours OR raise weekly salary to new threshold ($913 a week).
This three question test is not reflecting the new changes to Highly Compensated Employees (HCEs) test.
