This is an important piece of legislation when it comes to sexual harassment in the workplace.
?
To better protect employees from workplace sexual harassment, shifting the focus to ‘prevention’. This means an employer would be liable for the harassment of employees and introduces a positive duty on employers to prevent sexual harassment.?

The employer must also have taken steps to implement the correct policies and procedures, such as providing sufficient and regular certified awareness training to staff and managers as well as regular reviews of policies.?

This new duty to prevent sexual harassment will be enforceable by an employment tribunal, where it has first upheld a claim for sexual harassment. A 25% uplift could be considerable, bearing in mind that the average sex discrimination award in 2022 was £37,607, which means if you as an employer are found in contempt of this new law, the average award would be increased by £9,401 meaning the new average calm would be £47,008.00.

No employer is exempt from this duty and all employers must act now to comply with the new positive obligation to prevent sexual harassment. Beyond simply trying to avail themselves of the defence that they took reasonable steps to prevent harassment, many organisations will want to use this opportunity to support their workforce and others who are particularly vulnerable.??

Even though providing education and awareness on this notoriously difficult subject is complex, it is also undeniably important. Face-to-face stop sexual misconduct within the workplace awareness training, leads to more effective communication.
