Do windows 4 & 5 require fire-rating?

Does windows W04 & W05 in this particular scenario need to be fire rated?

Question:

I have received the following question, and I thought I share this with you.

The Study room windows are outside 900 mm. However, the wall is within 900 mm.

In your opinion, does the window need to be fire rated in this case?

My response:

Assuming this is for Class 1a dwelling.

The quick answer is: No, windows (W04 & W05) do NOT need to be fire rated in this instance.

According to the following:

• 3.7.2.1 (a) ; and
• 3.7.2.3 (a) ; and
• 3.7.2.3 9(b) ; and
• Figure 3.7.2.2a

Any walls that are not parallel to site boundary line (Including any openings within them) do not need to be fire rated. So long as they are not less than 900 mm from any site boundary.

However. I have the following note to make here:

According to Figure 3.7.2.1 below, any walls that are located at right angels or more from the boundary are not required to be fire rated.

It states the following:

“No protection required for the wall at right angles or more to the boundary.” Notice it says “at right angles or more to the boundary” in this particular scenario, they are located at less than right angle or < 90 degrees to the boundary. Would that exemption still apply in your opinon?

MIND YOU: There is a trick here. ?? I think the answer is in this diagram below: ?Figure 3.7.2.2a.
