1. Mutual Agreement ??
Both parties must agree to dissolve the marriage and resolve key issues such as property division and child custody if any. This method is considered stress free.
2. Prepare a Written Agreement ??
A "divorce agreement" is drafted, outlining how your assets (both movable and immovable) will be divided. This document also addresses child custody, support, and visitation rights.
3. File Your Application ??
Once a divorce agreement is ready, both spouses file a joint application with the Primary Court. The court filing fee is 10,000 RWF (about 10 USD).
4. Notarization of the Agreement ??
The divorce agreement must be signed by both parties and notarized by either a public or private notary in Rwanda. This makes the agreement legally binding and credible in court.
5. Converting Unilateral Divorce to Mutual Consent ??
If one spouse initially files for divorce alone, this can be changed to mutual consent if both parties ultimately agree. This ensures flexibility during the divorce process.
6. Final Court Judgment & Divorce Certificate ??
After the Primary Court pronounces its judgment, there’s a 30-day waiting period before you can apply for a divorce certificate. This final step officially deregisters the marriage and completes the divorce process.
