Does the Illinois License Act require that we disclose if a house is haunted? As we get closer to October, we often hear questions about whether or not listing agents and brokers need to disclose the history of stigmatized properties. That history could include ghosts, violent crimes, disease, or death. In short, the answer is no; section 1520 of the Illinois License Act states that we have no legal duty to disclose facts about an act or occurrence on the property that did not affect its physical condition or environmental structures.?
However, it’s worth noting that real estate agents do have a duty to be honest, so if asked, they will likely tell you the truth, especially if the occurrence has been published. So if you’re wondering whether or not your future home may be haunted or have a negative history, just ask.?
