Terminating an employee who may have mental health issues can be a delicate matter to carefully plan.
Before taking any final action, consult with a mental health professional and an employment law attorney, who can guide you through the process and ensure that you're following the correct legal and ethical procedures.
If the employee's performance or actions are causing problems in the workplace, document these issues clearly and concisely. Make sure you have concrete examples and evidence to support your decision.
If you suspect or know that the employee is struggling with mental health issues, offer support and assistance such as an employee assistance program or a leave of absence.

When terminating (discharge or layoff or forced retirement) an employee, be compassionate and respectful, regardless of the reason for termination. Make sure you are following all legal guidelines related to termination, including any relevant disability discrimination laws.
Remember that terminating an employee who may have mental health issues may trigger a negative emotional response. Protecting all other employees after terminating an employee with mental health issues is an important consideration. Although you cannot provide departure details, inform staff that this employee has left employment. Ask them if they have concerns. Ensure that your remaining employees know how to report any potential retaliation or harassment.
Be aware of the potential for retaliation or revenge by the terminated employee and take appropriate measures to address any concerns or threats. Recent mass-shooting events have highlighted the relationship between the place and the shooter, as an employee or former employee or former student. ?If your physical work location is open to the public, it may be wise for the employer to consider enhancing security, such as locking all ancillary doors, installing security cameras with alerts, adding metal detection equipment, or even positioning a trained and licensed security officer at the front entrance with a legal weapon.
