  • Section 5(2) - Persons with disabilities have the right to live in the community.
  • Section 6 - The Act provides protection to persons with disabilities from being subjected to torture, cruel, inhuman or degrading treatment
  • Section 7- The Act ensures protection of persons with disabilities from abuse, violence and exploitation
  • Section 8 -Persons with disabilities are entitled to equal protection and safety in situations of risk, armed conflict, humanitarian emergencies and natural disaster
  • Section 9 - Children with disabilities not to be separated from their parents
  • Section 10 -The Act recognizes the reproductive rights of persons with disabilities
  • Section 11- The Election Commissions to ensure that persons with disabilities can cast their vote.
  • Section 12 - The Act addresses challenges faced by persons with disabilities in accessing the justice system
  • Section 13- Legal rights of person with disabilities
  • Section 14 - Appointment of Limited Guardian
  • Section 15- Persons with disabilities require high support

Workplace Protections:

One of the key components of disability rights is the provision for reasonable accommodations in the workplace. Employers are obligated to make adjustments that enable employees with disabilities to perform their job responsibilities effectively. Section 17 of RPwD speaks about measures to be undertaken by the government.

  1. Establish adequate number of teacher training institutions

Benchmark Disabilities:? Person with Benchmark Disabilities means a person with not less than forty percent of disability.

Rights of Persons with Benchmark Disabilities?

  1. Section 31 of the Rights of Children to Free and Compulsory Education Act, 2009 which states the right to free education in a neighbourhood school, or a special school of his choice.
  2. Section 32 of the Act requires all government? institutions of higher education and other higher education institutions aided by the government to reserve 5% seats for persons with benchmark disabilities.

Despite the strides made in the realm of disability rights, challenges persist. Changing societal perceptions and dispelling stereotypes about disabilities remain ongoing endeavors.
