RAJA DAN RAKYAT BERPISAH TIADA : DAULAT TUANKU

?As we move forward as a nation, one would have thought that the monarchies will wither away one day but in fact, our monarchy system remains embedded in the constitution. In the light of KBYMM YDPA’s birthday (Hari Keputeraan), there are certain matters that we should be informed of and be well-versed about. There is no dispute that Malaysia practices Parliamentary Democracy and Constitutional Monarch. This discussion will focus on the latter, where a constitutional monarchy means a monarchy system allocated in the constitution or the YDPA shall act within the purview Federal Constitution or upon the advice of the PM.

Way before Malaysia achieved its independence, the king has been the backbone of governance and the symbol of state’s sovereignty, for example during the Melaka Sultanate. The YDPA is at the highest position in the Constitution, in line with the function of the royal institution which not only protects religion, but also serves as a symbol of unity and well-being of all races.

A vast array of powers is vested upon the YDPA through the Constitution and by the federal legislation. While we witnessed various political dispute, conflict, shakedown and two Prime Ministers within these 3 years, the only constant in this debacle was the YDPA. As he is safeguarding the interest of the Rakyats and keeping the nation’s harmony intact during the political fiasco, it can be seen through various conduct of the YDPA where he established a new precedent in summoning the members of parliament to query on several matters in order to resolve such conflict.

In the midst of the YDPA safeguarding the nation’s harmony, the parliament seemed to be neglecting the YDPA’s power. This occurrence can be seen through the revocation of all six of the Emergency Ordinances introduced during the State of Emergency period, whereby Datuk Seri Takiyuddin Hassan had revealed during the special Dewan Rakyat sitting that the ordinances were revoked on July 2021. This is because Article 150 (2b) of the Federal Constitution, read together with Article 150 (3) of the Federal Constitution, clearly provides that the power to enact and repeal emergency ordinances rests with the YDPA.

The YDPA has also reminded that Malaysia's economic recovery needs to be accelerated so that the country will not be left behind and expressed confidence that the country's economy would benefit greatly through the regional and international economic free trade agreements signed by Malaysia.
