Directly apply for British citizenship!

Have you ever heard of a provision where you can directly apply for British citizenship, without the need of any ILR or Settled Status?

This magic provision is section 4L of the British Nationality Act 1981. It was introduced in June 2022. It allows for an Applicant to directly apply for British citizenship, if it can be shown that had it not been for Government's errors / mistakes / wrong application of law / delay, the Applicant would have been a British citizen by now.

In a test case, we have recently argued that an Applicant without even achieving ILR in the United Kingdom, qualifies for British citizenship. The Home Office have contested the claim, and the High Court has granted permission for a judicial review.

This landmark case, S v SSHD, marks the first time the High Court will interpret Section 4L of British Nationality Act 1981.
