Establishment of a central control unit

The Bavarian government decided to establish a central control unit at the State Office for Health and Food Safety (LGL). This unit is responsible for granting licences to cultivation associations and monitoring them. Regular checks on the cultivation associations are planned, at least once a quarter, as well as event-driven reviews. Around six million euros have been set aside for the development and operation of the control unit.

Strict line on licensing for cannabis social clubs (CSC)

Bavaria is taking a particularly restrictive line on licensing for cannabis social clubs (CSC). Strict conditions are required for a CSC to be licensed, including:

  • A detailed security concept: Each CSC must present a concept that regulates the secure storage, access to the premises and the dispensing of cannabis. This includes the installation of video surveillance and secure storage rooms.
  • Proof of non-profit status: The CSC must be operated on a non-profit basis. All income must be used for the purposes of the association or for prevention programmes.
  • Limited membership: A CSC may have a maximum of 500 members in order to facilitate monitoring and compliance with legal requirements.
  • Geographical location: CSCs must not be located near schools, kindergartens, youth centres or other facilities primarily used by minors.
  • Prevention work: Each CSC is obliged to organise educational events on the responsible use of cannabis at least once a year and to document the participation of its members.

The approval process is multi-tiered and includes review by the central control unit, site visits, and final approval by the respective district administrative authority. Applicants must submit comprehensive documentation, including a business plan, proof of financing, and insurance against liability risks. In practice, many applications are rejected because they do not meet the strict criteria.

Increased prevention measures in schools

In view of the legalisation, Bavaria intensified its prevention work, particularly in schools. Since November 2022, about 250 moderators have been trained to conduct workshops on cannabis in around 550 school classes by the end of 2023. The aim is to offer the programme across the board so that every school class in grades 8 to 10 receives age-appropriate education. In addition, an online training programme for teachers was launched in January 2024 to train them in dealing with cannabis-related situations.

Police measures and controls

The Bavarian police have a critical view of cannabis legalisation and do not consider it a suitable measure for curbing the black market. Since the KCanG came into force, 823 violations have been registered in Bavaria. The police carry out regular checks and work closely with the central control unit to ensure compliance with the law.

Conclusion

Bavaria is implementing the Cannabis for Consumption Act with a strong focus on control and prevention. The establishment of a central control unit, strict licensing of cannabis social clubs, increased prevention measures in schools and consistent police surveillance are designed to ensure the protection of health and minors in the Free State.
