The Delhi High Court, presided over by Hon'ble Justice Amit Bansal, has granted an ex-parte interim injunction in favour of USMS Saffron Co. Inc. against J.S.V. Products. The case, filed under CS(COMM) 938/2024, concerns alleged trademark and copyright infringement involving the plaintiff's well-known "BABY BRAND SAFFRON."
Case Background:
USMS Saffron Co. Inc., engaged in saffron processing since 1965, holds trademark registrations for "BABY" and "BABY BRAND SAFFRON" and claims copyright over its product labels. The plaintiff alleges that J.S.V. Products sold saffron under a deceptively similar brand, "BOBY BRAND SAFFRON," using similar packaging, artistic features and essential elements, which could mislead consumers.
Court’s Decision:
Interim Injunction: J.S.V. Products is restrained from manufacturing, marketing, or selling saffron under the contested mark.
Website Blocking: The defendant's website, similar to the plaintiff's domain, will be blocked.
Local Commissioner Appointment: An advocate is appointed to inspect the defendant’s premises in Ahmedabad and seize infringing goods. Law enforcement will assist in executing the commission.
The case is scheduled for further hearings before the Joint Registrar on January 10, 2025, and before the Court on February 14, 2025.
