DELHI HIGH COURT CANCELS CCI INVESTIGATION INTO JCB, AFFIRMS FAIRNESS OF MEDIATION PROCESS

BACKGROUND

The CCI and JCB litigation was ?started when Bull Machine an Indian company claimed that JCB was abusing its strong market position by bringing baseless claims of design infringement. In response ?CCI opened an inquiry into JCB in 2014. The Bull Machine withdrew its complaint meanwhile after the case was resolved in 2021 under the supervision of the Supreme Court through mediation. The CCI persisted in its investigation in spite of this leading JCB to request court intervention.
