DELETING OPPOSING VIEWS REGARDING ICCRC!

Lawyer Ravi Jain @RaviRandalJain wrote his opinion in the Globen Mail regarding the government propping up ICCRC. SO HERE IS MY RESPONSE!

David J. LeBlanc blaming Ghost Consultants for MP's from all the three major parties to recommend "DEREGULATION" of ICCRC after conducting weeks of the standing committee hearings about Immigration Consultants is NOT acceptable.  

There always has been and always will be Ghost Consultants. A Lawyer in _________ country has a spouse come in to have him/her assist with filling the forms in English has every right to charge a fee for their advice. They are not breaking the Laws of their own country. 

The Members of Parliament saw "NO "DISCIPLINE" byICCRCRobert Kewley could not even answer the question as to how many members have been suspended or revoked. A board member from ICCRC said NO IDEA and then accused MP's of being Ghost Consultants. 

ICCRC themselves claimed they get 300 complaints a year and the MP's claimed they get 300 complaints a week about Immigration Consultants.

 ICCRC was created to fail because of the lack of the educational component not being sufficient. It was always about getting more and more consultancy students to join ICCRC, not quality representation. Consultants could not make enough money by just filling in forms and some regrettably turned to crime.

Phil Mooney refused to require approved educational providers by making them instruct in tribunal business. Now I have led a twitter storm defending Consultants against this very Lawyer and his cronies. I believe consultants ensure access to justice and must continue representing clients but under a better regulator.

A prime example of why ICCRC has got to go is the Smedley Prescod situation. IRPA allows every Consultant to represent clients at all three Divisions of the RB yet ICCRC has a clause 5.3.1 saying if not competent shall not represent the client. ICCRC had seven years to require that all members be trained in the tribunal business that failed miserably. Phil Mooney excuse for ICCRC not acting was that ICCRC could not hurt the Consultancy students already enrolled. The #CIMM pointed this out clearly and ICCRC has done nothing for two years and now the Minister has come out to enforce two-tier regulation.

Smedley Prescod was doing 3-5 detention reviews a week and represented two of my clients that he charged $5,000.00 each for a detention review which people paid when they feel desperate. Ridiculously high fee! Smedley was representing clients at admissibility hearings at least once a week. I have seen him at the IAD and the IRB. He was found to be INCOMPETENT not by our regulator, but by the IRB and PROHIBITED from representing clients at all three divisions of the IRB. He had been convicted of smuggling people into the USA and ICCRC was informed of this yet a member in good standing. ICCRC left him as a member in GOOD STANDING but also prohibited from IRB representation. 

If ICCRC actually cared about protecting the consumer of those seeking Immigration advice they would not have allowed every member to embellish their credentials as long as they included the ICCRC logo in their advertisements. Again the Minister has come out to prevent Consultants from calling themselves something that they are not "Immigration EXPERTS" etc. etc. 

It is long past time to let the government take total control over the Immigration Consultant industry so we will finally have respect like those in Australia. 

These Lawyer and others WANT Consultants to continue with the incompetence of ICCRC regulator types so they can use example after example to look down on us.

Imagine the feeling that potential clients would have if Consultants were regulated by the government of Canada and the type of assurances that all potential customers would have because Canada as a country is respected.
