DDOI Withdraws Supreme Court Application to Stay Proceedings and Recall 3rd Circuit's Mandate

In a letter posted to the Supreme Court docket in Delaware Department of Insurance v. United States, Counsel for the DDOI has withdrawn its July 21st application to stay proceedings and recall the 3rd Circuit's mandate. Per the letter, the parties "have reached an agreement to avoid the irreparable harm to the Commissioner pending a decision by this Court on a petition for Writ of Certiorari or on the merits if certiorari is granted. Accordingly, upon agreement of the parties, Applicant respectfully withdraws its application for stay and thanks the Court for its consideration."
