Are you looking to launch a website? Did you know Indian Cyber Laws require every website to publish a legally valid Terms of Use, Privacy Policy & Cookie Policy?
There are Indian Cyber Laws that you must know if you own a Website.
We've compiled a list of some of the most important legal practices you need to consider. Read on to find out more and make sure your website is up to legal standards!
- Domain Name & Trademarks: Registering a domain name is the first step towards building a website. It is important to ensure that the domain name you choose does not infringe on any trademark or copyrights. For this, individuals should conduct a Trademark Search to ensure the domain is unique and does not infringe any trademark. This is very simple and absolutely FREE. Use this https://ipindiaonline.gov.in and ensure that your website does not infringe on any intellectual property rights, such as copyrights, trademarks, or patents. Use of copyrighted materials or trademarks without permission can result in legal action against you.
- Browser Wrap Agreement: While setting up a website there must be a website’s term of use document that outlines the terms and conditions for using your website. This document should include information about the use of the website, intellectual property rights, disclaimers, limitations of liability, and more. This may include an “I accept” (as illustrated in the image) prompt immediately for the user when they visit the website. It is an electronic contract as per the provisions of Section 10 (A) of the Information Technology, Act 2000.
- Privacy Policy: You are required to have a privacy policy that outlines how you collect, store, and use the personal information of your website users. This policy follows the provisions as laid down in Information Technology Act, 2000 in conjunction with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
- Cyber Law Compliance: Websites operating in India must comply with the Information Technology Act, 2000. It deals with cyber crimes, data protection, and electronic signatures. Section 10 of this act, says there must be a browser agreement (Terms of use and Privacy policy) on a website. Section 67 states that a user must not send obscene material using an electronic form, nor shall he publish materials containing sexually explicit acts.
- Cookie Policy: If you use cookies on your website, you need a cookie policy explaining how you use cookies and obtaining consent from users to use them. The Indian law on this subject is very ambiguous, as there is a provision in Consumer Protection Act, as mentioned in Section 2(46) that any practice which puts unreasonable imposition on a user and thus certainly puts the user in jeopardy shall be treated as unfair trade practice.??
- Accessibility Compliance: Ensure that your website is accessible to all users, including those with disabilities. This is a legal requirement under the Rights of Persons with Disabilities Act, of 2016.
