Will the Court Block the T-Mobile Sprint Merger?

I read a great post by Monica Alleven, the senior editor of FierceWireless, where she analyzed the likely outcome of the T-Mobile/Sprint merger litigation. In her analysis, she estimates a 40% chance of the court's approval. Her estimate is in line with most analyst predictions.

My question is, what happens if she's correct and the merger request is denied? No doubt an appeal. Now that the timeframe has already been stretched much longer than anyone would have imagined, it will likely be even longer. And in case no one has noticed Sprint is not in a financially healthy and robust position to continue to operations, let alone roll out a new 5G network. Probable outcomes are that Sprint goes through bankruptcy or is sold off in pieces. Either case leads to a reduction in the competitive environment. If the merger doesn't go through, will T-Mobile have the needed customer base and wireless spectrum to warrant building out a new 5G network?

Nowhere in the legal discussion do I find the impact on the independent dealers selling Sprint/Boost and T-Mobile/Metro services. This state of flux has already caused severe, and in some cases, fatal harm to some of these small business owners as T-Mobile/Sprint management is paralyzed by the unclear future. Grave damage has already been inflicted on the two carriers dealer networks.

We headed down this path to where we are today almost 15 years ago when in February 2005, the Sprint Nextel Merger began. That ill-conceived merger of very different, but strong wireless companies started. Sprint's loss of management focus, money, and customer base weaken Sprint to the position they are in today. Sprint needs an overhaul. Like this merger or not, this issue needs to be resolved as quickly as possible; otherwise, the feared damaged of the weakening in the competitive environment will have already occurred.

Let's see what the new year holds in this merger. Wait, I think we were saying that last year at this time.
