Could new Commission Rules Discriminate Against VA Buyers?

As the real estate world is trying to navigate procedures relative to commission structures....Is it possible VA Buyer's could be hurt in the process ?

We want transparency-let's talk about this as a possibility.

A Veteran may qualify for a VA loan that entitles them to put no money down and borrow 100% of the purchase price, guaranteed by the government.

A benefit well-deserved for someone who was willing to sacrifice their life to protect the lives of others.

With the ambiguity of how to pay commissions this can leave this group of people vulnerable if the compensation for the buyer agent does not come from the deal and the veteran be required to pay out of pocket. Yes, this can happen to many buyer's but today is Veteran's Day so the topic is correct for today.

Some talk about building the compensation into the deal. In this scenario the veteran is already borrowing a 100 percent of the purchase price and building it in would be prevented in the loan.

If the veteran/buyer agent asks for compensation to be be paid to the agent and the seller turns them down... are they discriminating against someone in a protected class? Easy to say no - they just don't want to pay-but the veteran falls into a protected class. If another buyer offered more than asking price and asked the same terms and the seller said yes-it is treating two people differently?

Yes it is ! Now it could be said it is because of financial terms but one falls into a protected class and another does not. Hmmm. Perception ??

I can't tell you I have a solution but I felt it important to put this topic out for discussion today.

200 %. True! VA loans are already thought of as “the worst” loan to take by ill informed sellers and sellers agents. As an example of the negativity toward VA loans , Of the thousands of condo complexes in America only a handful of HOAS allow the Veteran buyer to purchase in thier Community using a VA loan. And Sellers under the guidance of sellers agents only take a VA loan as a last resort. The truth is it’s the easiest to get approved. IMO This proposed ruling must have a carve out for VA buyers
