Copyright Office & Congress -Improving Legal Access?
Listened to this wonderful podcast over the weekend from Volpe Koenig and Michael Snyder & Joseph P. Gushue on the new(ish) Copyright Claims Board (CCB). It is a great introduction to the CCB for attorneys and creators alike. After spending years in Big Law IP litigation, it is truly out of reach for so many artists and creators to protect their works due to the hundreds of thousands of dollars required just to get through discovery. Hopefully, we will see this new CCB as an effective ADR to increase legal access for creators to protect their rights and for the public and others to protect themselves by claiming fair use.
What: Congress recently created the Copyright Claims Board (CCB).
When: In December 2020, Congress passed the Copyright Alternative in Small-Claims Enforcement Act of 2020 (CASE Act). After years of getting feedback from stakeholders and the public, the CCB formally opened its doors last year.
Why: Provides an efficient and user-friendly option to resolve certain copyright disputes that involve up to $30,000.
How: The CCB is a three-member tribunal within the Office.
