Steps to be followed:

The convening session in mediation is a crucial phase where the mediator sets the tone for open communication and establishes a comfortable environment for the parties involved.

Begin the session with introductions. Allow each party to share a bit about themselves, their background, and any concerns they may have. Consider using icebreakers to lighten the mood and encourage participation.

Communicate in a positive and non-adversarial tone. Emphasize the collaborative nature of mediation and the shared goal of finding mutually agreeable solutions. Reinforce the idea that mediation is a safe space for open communication.

Provide a clear overview of the mediation process, including its voluntary nature, confidentiality, and the role of the mediator. Ensure that parties understand their active participation and decision-making role in the process.

Emphasize your role as a neutral third party. Reassure the parties that your goal is to facilitate communication, not to take sides or make judgments. This helps build trust and encourages openness.

Collaboratively establish ground rules for the mediation session. Discuss and agree on guidelines for respectful communication, active listening, and any other rules that may facilitate a productive conversation.

Recognize that emotions may be running high. Acknowledge the parties' feelings and assure them that emotional expression is welcome in the mediation process. Encourage open dialogue about emotions if it feels appropriate.

Be attentive to power imbalances and work to address them. Ensure that all parties feel heard and have an equal opportunity to express them. Consider private caucuses if necessary to address concerns confidentially.

Demonstrate empathy by acknowledging the challenges the parties may be facing. Show understanding of their perspectives and validate their emotions. This helps build rapport and fosters a sense of safety.

Reinforce the importance of open communication. Let the parties know that their input is valuable and that the mediation process is designed to facilitate a constructive dialogue leading to resolution.
