Case? QBE UK Ltd v Hilton [2023] EWHC 2004, High Court
Facts? H issued proceedings against QBE related to an accident at work. He claimed compensation of £600,000. As the case progressed, the employer suspected that H had exaggerated his injuries and had made false statements. He claimed that he could not drive and could only walk a few steps. QBE obtained surveillance footage which showed H driving and walking normally. He had also forged documents related to his medical records. QBE brought proceedings for contempt of court.
Decision????? 1. H was sentenced to 10 months imprisonment.
2. Immediate custody was ordered to signal the gravity with which the court would deal with those seeking to gain from false and grossly exaggerated personal injury claims. ?
