Concept Breakdown, Issue 22: Gag Orders

Concept Breakdown is a weekly newsletter by The Analysis (TA), explaining technical concepts that are in the news. The newsletter tries to educate readers on these key terms to avoid misinformation and promote informed discussions.

A gag order refers to a legal directive issued by a court or governmental authority that restricts individuals or entities from making public statements, disclosing information, or reporting on specific legal matters.

These orders are typically imposed to protect the integrity of ongoing legal proceedings, prevent media from influencing public opinion or the jury, or to safeguard the privacy and reputation of individuals involved in sensitive cases.

Key aspects of gag orders in India:

  1. Legal Basis: Gag orders in India are not explicitly mentioned in any statute, but they are issued under the inherent powers of courts as provided by the Constitution of India. The courts derive these powers from Article 19(2), which allows reasonable restrictions on the freedom of speech and expression in the interest of, among other things, the administration of justice.
  2. Types of Cases: Gag orders are commonly issued in cases involving high-profile individuals, sensitive criminal trials, matters involving national security, and cases related to minors or sexual assault victims.
  3. Enforcement: Violation of a gag order can lead to contempt of court proceedings, which may result in penalties including fines and imprisonment.
  4. Controversy: Gag orders are sometimes seen as conflicting with the freedom of the press and the public's right to information. Balancing these interests with the need for a fair trial and privacy protection is a challenge for the judiciary.

Why is it relevant today?

In the recent Kolkata rape-murder case, the Calcutta High Court dismissed the plea for a media gag order by Dr. Sandip Ghosh, ex-principal of R G Kar Medical College. Ghosh had alleged that media houses had been publishing untrue information about his involvement in the unfortunate incident.?

The court in its decision stated that the Kolkata case had attained a status of global importance. It further highlighted that the right to information is fundamental in this case as each and every member of the civil society is severely affected by the incident, either directly or indirectly.
