Concept of Maternity Benefit Act, 1961.
Everyone knows that Pregnancy is a crucial part of women's life. They need to go through a unbearable pain along with physical & psychological stress. Since, they a need a break for a while from their professional life. To ensure an equality in employment status in every women's life this Maternity benefit act has been passed.
So, what is Maternity benefit act?
This act ensures the employer will not terminate its employees at the time of maternity leave (or) refusing to pay their salaries on time during this period (or ) No loss of pay will be considered.
As per the act, every other women employee can avail maternity leave upto 26 weeks whether pre or post delivery of their child.
If they have any medical complications, they can extend their leave as well.
And most importantly neither the employee should not resign from the employment nor employer can't terminate the employee at the time of maternity leave.
