On October 24, 2023 the publisher for The Black DC, Thomas Anderson, filed a complaint with the Office of the Inspector General of the Department of Justice. The complaint was filed in response to a New Jersey State Commission of Investigations report, and documents filed by prosecutors in relation to the Senator Robert Menendez indictment of bribery and acting as an unregistered foreign agent. The complaint, which was given to the New York Post on an Exclusive basis, details the pressure campaign outlined in the indictments of the Senator on the employees of the United States Attorney's office of New Jersey. The pressure campaign mounted by the Senator was aimed at getting his co-defendant, Fred Daibes, off of multiple felony charges related to bank fraud and multiple other offenses. Daibes, according to the State of New Jersey Commission of Investigations, has connections to organized crime and used his position as a developer in Edgewater, NJ to totally control the local government there causing decades of mayhem resulting in higher taxes and endless investigations into shoddy construction work.
When examining the documents released by the Southern District of New York, and the New Jersey Commission on Investigations one thing shines clearly: The United States Attorney for New Jersey and his staff came under one of the most aggressive pressure campaigns ever applied by a sitting United States Senator. What makes this so much worse than an abuse of power is the apparent success Menendez had concerning the Daibes case. The gold and cash from Daibes in a series of meetings and car rides between overseas trips of Senator Menendez is what makes the filing of this complaint necessary. Sometimes, even government agencies can come under so much pressure they can't function and this is when an outside government watchdog like The Black DC comes in to shine a light so public pressure can act as an extra layer of support for the victims of Menendez and his co-defendants.

The crimes alleged and the multiple conspiracies surrounding them reveal a disturbing set of events that call for a global review and possible investigation into the actions of the United States Attorney’s Office for the State of New Jersey related a conspiracy to tamper with a Federal Court case being tried by that office.?

According to multiple news reports and case file information related to USA v Daibes et el 2:18-cr-00655-SDW-1 the United States District of New Jersey filed a multiple count indictment against Developer and political supporter and contributor to Senator Robert Menendez, Fred Daibes on 10/30/2018.? The indictment alleges several serious felony offenses and is still currently open.? This isn’t the first time Fred Daibes found himself in an ethical or legal quandary.? Indeed, in May of 2023 the State of New Jersey Commission of Investigation released a report detailing decades of potential fraud and abuse by Fred Daibes and the politicians he controlled out of Edgewater, NJ. ?In the report several mentions and citations are made proposing referrals made by the Commission of Investigation to other Federal agencies that may have had jurisdiction over alleged crimes committed by Fred Daibes.? A review of all these investigative documents, and related new reports are what is drawn upon in filing this complaint with the DOJ OIG.

According to the Southern District of New York superseding indictment of Senator Robert Menendez, ?on January 24, 2022 Fred Daibes received a text message from Nadine Menendez saying, “Thank you.? Christmas in January”. ?Approximately two hours after this text and the exchange of an envelope of thousands of dollars in cash Senator Robert Menendez contacted the Assistant US Attorney in charge of the Fred Daibes case.? Senator Menendez also googled the value of gold per ounce.? This call was followed with subsequent calls to this official as well as the US Attorney for New Jersey and his advisor. ?After an examination of local news reports, New Jersey state Commission investigative reports, and the indictment and superseding indictment of Senator Robert Menendez it is apparent the New Jersey Department of Justice and its officials have come under an intense pressure campaign from one of the most powerful members of Congress.? It also appears Senator Menendez is also backed by individuals, investigators in New Jersey have connected to organized crime.? Because of these circumstances and events surrounding such a high profile case it behooves the Office of the Inspector General to open broad, all-encompassing investigation into every facet of the high stakes corruption and foreign agent charges connected to Senator Menendez.?

It is apparent that Senator Menendez was vehemently attempting to influence the trial of Fred Daibes and it appears he was taking a “no holds bar approach” to accomplishing his goal.? When aligning the timing of events in available public documents it appears Senator Menendez was being rewarded with gold bars and cash for contacting officials prosecuting the Fred Daibes case in the district of New Jersey.? This exchange cited in the superseding indictment encapsulates the reward system set up around Senator Menendez applying pressure to prosecutors of the Daibes case:?

·?????? Menendez promises and seeks to disrupt a Federal Criminal Prosecution of Daibes in Exchange for Cash, Furniture, and Gold Bars.
·?????? From December 2020 to at least early 2022 Menendez attempted to influence the pending prosecution of Fred Daibes.?
·?????? On October 17, 2021 was picked up and dropped off at home with his wife Nadine by Fred Daibes.? On arrival Menendez performed google searches on the value of certain amounts of gold, googling, “how much is one kilo of gold worth”. (Multiple gold bars were seized when a June 2022 warrant was served on Menendez personal residence)
·?????? On January 21, 2022 Menendez made several phone calls to DOJ officials in the US Attorney ‘s office of New Jersey regarding the Daibes case.
·?????? On January 22, 2022 Menendez was on a call with Daibes accusing Daibes attorney of not being aggressive enough with the US Attorneys handling the case against him
·?????? On January 24, 2022 Daibes driver provided Nadine Menendez with cash in an envelope that had the driver’s DNA on it.
·?????? From December 2020 until January 2022 Senator Robert Menendez continually contacted the US Attorney for New Jersey concerning the Daibes case.

It would appear the multiple contacts with officials from the US Attorney’s office of New Jersey by Senator Robert Menendez show he was having success at influencing the Daibes case.? Though the indictments never allege any wrongdoing by officials of the New Jersey office the fact that the US Attorney allegedly recused himself from the case yet continued to field calls from Menendez says a further investigation needs to be done to ensure no conflicts of interest or undue influence was used in the Daibes case.

The conduct outlined in the multiple indictments of Senator Menendez and his co-defendants show a willingness to disregard the law and treat the state of New Jersey as their own personal playground.? It is this type of behavior by elected officials like Menendez that has eroded the public trust in our institutions of government.? We are living in a sad situation due to the inaction and inability of the government to police itself.? It is my sincere hope and desire your office takes the information provided in this complaint to begin a thorough review of anything Senator Robert Menendez influenced within the jurisdiction of your mandate.
