Bravo Bilal. Nice article!! I am no expert by any means on this issue but a thing or two i know. I feel the huge budget of 50billion dollars serves as a negative incentive as well. I mean the law enforcers know their prisons can sustain more incarcerations, and perhaps the system loses sight of the value of the institution (which is rehabilitation) and the norm (apprehend and incarcerate) takes precedence over it. Maybe!! Just thinking out loud. Plus, as for Pakistan, budget for the police has always been and will remain an issue. Perhaps we require more intelligence lead policing and some low hanging fruits need to be harnessed on priorty. Like, if an IO has confidence he can release someone for lack of evidence u/s 169 of crpc, that will lower the incarceration, if magistrates in fact do practice haebus corpus that will also arguably have a similar effect. The justice -of - peace FIRs need to be streamlined more. I do understand the counter-nattative of the misuse of these things though. Importantly, glad to read your article. It actually punishes the criminal. Based on retribution, deterrence and reform; the theory is that such punishments will deter most from committing crimes. Rehabilitation Rehabilitation can take two forms – preventive and remedial. Rehabilitation helps a child, adult or older person to be as independent as possible in everyday activities and enables participation in education, work, recreation and meaningful life roles such as taking care of family.
