"Common Contractor abuse Stopped in its tracks"

I remember the first time I heard about "Summit Construction" - a general contractor for commercial real estate projects. Their name was similar to a supposedly reputable contractor, but it wasn't long before I realized that their business practices were far from reputable.

My company was in the process of renovating a large apartment property and had hired "Summit Construction" as the general contractor. We were promised quality work, fair pricing, and timely completion. However, as the project progressed, we noticed that the subcontractors and suppliers were not being paid on time or in full, despite it being Summit's contractual responsibility. The job was dragging far out and we found the cause when it was too late. We now had a $385,000 lein on our property.

It soon became apparent that "Summit" was using this tactic as a means of emotional and financial abuse, hoping to pressure female clients like myself into paying them what they hadn't earned. This was a clear case of extortion, and it was unacceptable.

Unfortunately, our experience was not unique.

WITH AN ABUSER IT IS NEVER THEIR FIRST TIME. ABUSERS GET MORE EMBOLDENED WHEN THEY GET AWAY WITH A CRIME EACH TIME.

THEY GET A HIGH LIKE A DRUG TO KEEP ABUSING.

This is why accountability is CRITICAL for the entire commmunity.

The owner of the company had multiple witness' to his consistent drinking which heightened HIS risky behavior with clients and subcontractors.

"Summit" had repeated these abusive actions to other women-owned companies, including a Texas roofing company and a large multi-billion dollar supply business ABC Supply owned by more powerful woman. We are all witness' to his behavior cycle.

That's why we came together to expose Summit on live television news as our next breaking story.

I knew that we needed to take legal action, and that's when we learned about fraudulent liens under Texas property code. As defined by Section 51.901(c)(2) of the Government Code, a fraudulent lien is a lien filed by someone who knows that the claim is invalid, false, or fraudulent. This Lein in particular has subcontractors, suppliers, consultants, attornies, myself, and other Global contracting companies who looked at the work to all be witness to the fraudulent lein concocted to abuse the business leaders trying to get ahead.

To combat this, we can

1-file a fraudulent lien suit (also known as a summary lien)

2- place an escrow bond with our title company

3- place a surety bond on the lein/Remedial Bonds Under Section 53.171 of the Texas Property Code

4-file for Statutory Damages for Fraudulent Liens

5-Criminal Law on Fraudulent Liens. Refusal to execute a release of a fraudulent lien or claim, under Tex. Penal Code § 32.49, is a Class A misdemeanor!

6-check your statute of limitations for lein type- YOU can outrun

and a few other defensive moves in stealth to stop the ameatur-hour scare tactics.

These actions cleared our title and stopped the abuse from continuing.

Eventually, we received a judgement against "Summit Construction", and they were blacklisted from ever receiving any government contracting work. As a former Marine or service-person you never want this to be the case.

WE WERE PROACTIVE keeping record of EVERY TRANSACTION, EVERY CONVERSATION, EVERY PICTURE, DATED WEEKLY MEETINGS WITH MINUTES.

You must do the same.

NO ONE WILL DO IT BUT YOU. DOCUMENT DOCUMENT DOCUMENT.

Don't forget TEXAS IS A SINGLE PARTY DISCLOSURE STATE.

When recording the other party it is not required to disclose this. Ideally reducing abuse.

As women in business, ESPECIALLY IN CONSTRUCTION, it can be challenging to face these kinds of situations. However, we are powerful when we stand together in teams, We demand accountability, and we will not allow these kinds of practices to continue.
