As most states, including New York, gear up for the end of Daylight Savings Time (Sunday, November 5th!), let's talk about the overnight workforce. Unlike the rest of us, these night owls face a time-twisting anomaly - working an hour more when the clocks fall back. ????
Picture this: It's a regular graveyard shift from 11:00 p.m. to 7:30 a.m. On a normal day, this includes a solid eight hours with a 30-minute lunch break. But, when DST ends, and we gain an extra hour at 2:00 a.m., they clock in nine hours.
The FLSA is clear - every hour worked is an hour paid. So for those who worked through the 'time warp', they're due 9 hours' pay, not 8. And when DST begins and they lose an hour, they should get their full 8-hour pay despite working only 7. It’s not just compliance; it’s also respect for their time and adjustment.
