A CLIENT'S SUICIDAL STRATEGY

Unquestionably, outside the courtroom, a client has autonomy to make whatever decision he wants, even if against his lawyer’s advice. We see the exercise of that autonomy daily in the press. But in the courtroom? The Supreme Court has just accepted McCoy v. Louisiana for argument. It will be an important ruling on a client’s ability to make critical litigation decisions, even if his lawyer adamantly disagrees. See my thoughts, now up on Huffington Post.
