As we enter into 2025, the world of HR is ever-changing with expectations on how to attract and retain top talent as well as technology.?
According to research conducted by TestGorilla, in 2024 81% of employers have focused on skill based hiring. Due to the labor shortages, employers have to become creative on attracting and retaining talent.?
There is also a increasing trend of employees who have retired returning to work part time or PRN. These employees typically have a wealth of knowledge and skills to share with employees.?
Technology is driving all areas of business. Due to high demands by consumers, there is a need to have new hires start training on technology during the onboarding process to cut down on the time it will take for them to start training afterwards.?
Here some additional takeaways and insights gained from the article:

REMINDER: Recent changes to the H-2A and H-2B programs provide employers – particularly those that rely heavily on seasonal and temporary labor like the agriculture, farming, hospitality, landscaping, and construction sectors – with greater workforce flexibility. Workers can now start with a new employer as soon as an extension petition is filed, eliminating previous waiting periods. It’s important to note, however, that the new rules introduce stricter worker protections, such as anti-retaliation measures, wage documentation requirements, and health and safety standards. Employers must also comply with USCIS inspections and ensure transparency in wage and benefit reporting. https://www.dhs.gov/news/2024/12/17/dhs-helps-companies-fill-more-jobs-strengthens-worker-protections-h-2-programs

NOTE: AI regulation looks to be top of the agenda for the Trump Administration. With his appointment of David Sacks as the country’s new “AI & Crypto Czar,” President-elect Donald Trump signals a new era promoting growth and collaboration and minimizing barriers that could stifle innovation. While that will likely mean good news for employers, who should benefit from the expected influx of workplace AI tools, they’ll still need to stay on top of regulatory changes to reduce risk and uncertainty. And take steps now to position themselves for the new AI normal. https://www.fisherphillips.com/en/news-insights/david-sacks-named-ai-czar.html

RE OHIO: In late November, the Ohio Supreme Court ruled in State ex rel. AutoZone Stores, Inc. v. Industrial Commission, that an employee’s eligibility for temporary total disability (TTD) compensation requires demonstrating that the inability to work is directly caused by the work-related injury, not by factors unrelated to the injury. This ruling reinforces the importance of maintaining clear employment policies and documentation, as terminations for reasons unrelated to a workplace injury can disqualify an employee from receiving TTD benefits. In addition, to effectively contest unwarranted TTD claims, employers should be prepared to demonstrate that an employee’s inability to work is due to factors other than the work-related injury. https://www.supremecourt.ohio.gov/rod/docs/pdf/0/2024/2024-Ohio-5519.pdf

By the Numbers: RIP, 80/20 Rule! On December 17, 2024, the Department of Labor repealed its 2021 rule restricting employers' access to a tip credit for employees performing both tipped and non-tipped duties. This follows the 5th Circuit Court of Appeals' August decision, which found the rule inconsistent with the Fair Labor Standards Act. The DOL's action confirms employers can claim a tip credit for time spent by tipped employees on non-tipped work. https://www.hrdive.com/news/5th-circuit-tosses-dol-tip-credit-final-rule/725296/
