Clause 6- Staff and Labour

In a nutshell : The Contractor is responsible for arranging the engagement of all staff and labor, including payment, housing, feeding, and transport, unless otherwise specified in the contract. The Contractor must pay wages and adhere to labor conditions that are at least equal to those established for the relevant trade or industry where the work is being done. If there are no established rates, the Contractor must ensure that wages and conditions are not lower than the local general level observed by similar employers. The Contractor is prohibited from recruiting or attempting to recruit staff and labor from the Employer's personnel. The Contractor must comply with all relevant labor laws concerning the employment, health, safety, welfare, immigration, and emigration of their personnel. Work on the site should not be carried out on locally recognized days of rest or outside normal working hours unless specified in the contract or approved by the Engineer. Exceptions may be made for unavoidable work or for safety reasons, with immediate notification to the Engineer. The Contractor is responsible for providing and maintaining necessary accommodation, welfare facilities, and hygiene requirements for both Contractor's and Employer's personnel, as specified in the contract. The Contractor must take reasonable precautions to ensure the health and safety of their personnel, including providing medical staff, first aid facilities, and preventive measures against epidemics. They must appoint an accident prevention officer and report accidents promptly to the Engineer. The Contractor must provide sufficient superintendence to plan, manage, and inspect the work, ensuring satisfactory and safe execution. Superintendence should be provided by knowledgeable individuals proficient in communication and work operations. Contractor's personnel must be qualified, skilled, and experienced in their respective trades or occupations. The Contractor must remove any personnel who engage in misconduct, incompetency, or negligence, as instructed by the Engineer. The Contractor must submit monthly details of the number of Contractor's personnel and equipment on-site until all outstanding work is completed. These details should be approved by the Engineer. The Contractor must prevent unlawful or disorderly conduct among their personnel and ensure the peace and protection of persons and property on and near the site..
