And, now for a little compliance corner...?

• Updated FSA and Commuter Benefits Limits: The IRS released new maximum limits for health FSAs and commuter benefits on October 22, 2024, adjusted annually for inflation. Note that limits for Dependent Care Assistance Programs (DCAPs) remain unchanged, as they are set by statute and not adjusted yearly.
• State Individual Mandates for Health Coverage: Although the federal individual mandate penalty no longer applies, certain states now require residents to maintain health coverage or face penalties. Employers with employees in these states must report health plan enrollment information annually, with reporting requirements that vary slightly by state.
• Mental Health Parity Compliance Requirements for 2025: As part of the latest guidance under the Mental Health Parity and Addiction Equity Act (MHPAEA), employers must ensure that their health plans offer equitable access to mental health and substance use treatment. Compliance requirements include updated reporting and plan assessments to confirm parity in benefits coverage. Employers should review their plans to ensure they meet these standards to avoid potential penalties in 2025.
