Over the past year, how effective have courts and tribunals been in applying the CISG and promoting uniformity in international trade? In 2024, the CISG continued to demonstrate its significance in international trade, with over 175 reported cases across various jurisdictions. Notably, Tanzania reported a CISG-related case for the first time. However, it is important to note that this figure likely represents only a fraction of the total, as many cases—particularly those involving commercial arbitration—remain unreported. [NB: Reported numbers typically increase the following year due to backlogs in reporting in many jurisdictions.]
The 2024 cases addressed a broad range of issues, including the incorporation of standard terms, damages, non-conformity, jurisdiction, and the interplay between the CISG and EU law, as well as the Convention on the Use of Electronic Communications in International Contract.
