???? Unlocking Protections for Child Influencers ????
The story of Britney Spears and her conservatorship has raised questions about legal safeguards for child influencers. These young stars, like their adult counterparts, sing, dance, cook, act, and promote brands, all while making money from sponsored posts. But unlike adults, child influencers have minimal legal protection, leaving their earnings at risk.
In 1938, child star Jackie Coogan faced a similar issue when he discovered his earnings were spent by his parents. California enacted the Coogan Law in 1939, ensuring a portion of child entertainers' income goes into a trust. A few other states have similar laws but don't include child influencers on platforms like Instagram, TikTok, or YouTube.
Child influencers often follow scripts and directions, but unlike traditional entertainment, they lack significant legal protection. Even if they create their content, they may still be vulnerable to exploitation. Social media platforms restrict children under 13 from managing their accounts, and most states don't allow children to open bank accounts independently until age 17.
Now, change is underway, spurred by teenagers concerned about child exploitation cases. Illinois recently passed a groundbreaking law, the first in the U.S., which requires adults profiting from a child's image in online content to set aside a share of earnings in a trust. This measure was inspired by Shreya Nallamothu, a high school student who wrote to her state senator advocating for child influencer protection.
The law, effective from July, mandates that the portion set aside depends on a child's level of involvement in the content. This means if a child stars in 100 percent of videos, at least 50 percent of earnings must be allocated to the trust. While the law doesn't require parents to disclose earnings to the state, it grants child influencers the right to take legal action.
In Washington State, college sophomore Chris McCarty, also known as Mx., has been working on a law to safeguard child social media stars. The bill, introduced in January, proposes that parents allocate 15 percent of their revenue to the trust. It also requires online platforms to remove videos at the request of a child influencer who has come of age if the platform has paid the parents for the content.
