In the digital age, the rise of conversational AI tools like ChatGPT has revolutionised the way we interact with technology. These tools have streamlined workflows, enhanced creativity, and provided solutions to complex problems.
However, as their adoption grows, so too does their significance as a potential source of evidence in legal and investigative contexts.
A recent example involves the CyberTruck that exploded outside of Trump Towers Hotel In Las Vegas. Matthew Alan Livelsberger, a 37-year-old U.S. Army Green Beret, used ChatGPT to plan an explosion outside the Trump International Hotel in Las Vegas on New Year's Day. He inquired about the amount of explosives needed, where to purchase fireworks, and the legality of such actions. Despite ChatGPT's safeguards and warnings against harmful activities, it provided publicly available information. Livelsberger's writings indicated he intended the explosion as a "wake-up call" and did not aim to harm others
Why ChatGPT Records Matter
ChatGPT and similar AI tools generate detailed interaction logs, which can serve as a valuable source of evidence in various scenarios. These records include timestamps, user queries, and AI responses, offering a clear chronology of interactions. Unlike traditional forms of digital communication, such as emails or text messages, AI-generated records are unique in their format, often reflecting a more structured exchange of ideas or instructions.
From my experience as a Digital Forensics expert, the key to uncovering evidence lies in context. ChatGPT records provide that context, whether it’s reconstructing a sequence of events, identifying intent, or verifying the authenticity of information shared during an AI interaction.
Legal and Investigative Applications
The application of ChatGPT records as evidence spans multiple domains:

Challenges to Admissibility
While the potential is immense, challenges remain in establishing the admissibility of ChatGPT records as evidence:
Future Implications
As conversational AI continues to evolve, organizations and individuals must adapt to manage and preserve these records responsibly. From implementing retention policies to developing forensic protocols, proactive measures will ensure these records can be leveraged effectively when required.
For digital forensics practitioners like myself, the inclusion of ChatGPT records adds another layer of complexity to investigations. It’s not just about collecting data; it’s about interpreting it in a way that aligns with the facts and supports the pursuit of justice.
Conclusion
ChatGPT and similar AI tools are not just innovations; they are part of our digital footprint. Recognising their value as evidence will shape the future of investigations, compliance, and litigation. By embracing these developments, we can ensure that justice and truth remain at the forefront in an increasingly AI-driven world.
If you’ve encountered scenarios where AI-generated records played a role in an investigation or dispute, I’d love to hear your thoughts. Let’s continue the conversation on how this emerging area can shape the future of digital forensics and legal proceedings.
