ChatGBT in Action: Analyzing the Likelihood of Confusion of Trademarks

Today, I had the opportunity to train ChatGBT to assess the likelihood of confusion of word marks, a typical task in trademark cases. I have to admit, it's great fun.

When utilized by experienced professionals, this tool can significantly enhance our daily IP work. However, it is essential to recognize that ChatGBT, like any other technology, relies on accurate input from skilled individuals. Without a skilled expert behind the keyboard, even the most sophisticated AI will be limited in its effectiveness. This is illustratively shown by the two following results that ChatGBT has delivered to me today. If you simply ask him about the risk of confusion between the characters PICARO and Picasso, the result is unfortunately of little legal use. But if you ask him the right question, you get an impressive result.?It's just more important than ever to ask the right questions.
