Last year, the Supreme Court handed down their decision in Facebook v. Duguid. The decision finally gave us a clear, narrow definition of an “automated dialer” as a system that makes calls using random or sequentially generated numbers. As such, calling from a list of specific phone numbers no longer falls under the definition.

We expected this definition to be challenged and tested, so we urged our clients to take a slow, cautious approach. However, this decision has overcome many challenges in lower courts thus far, and in our opinion (and that of our legal counsel), appears to be solid.

After 10 years of manually dialing cell phones one-by-one, we can now use the predictive dialer to increase the speed and efficiency of reaching your audience on their mobile phone. Unlike for landlines, we cannot use recordings of any kind – either on live answers or voice mails to mobile phones. However, the use of the automated dialer dramatically reduces the amount of time agents spend dialing the phone and waiting for it to ring, so each agent can speak to more voters and complete more calls every hour.
