Capital Markets: Derivatives 2024

Published on 3 September 2024

At last,? Derivatives, a fundamental practice in commercial law, has been given its dedicated practice guide among the Chambers titles. Derivatives are those notorious powerful instruments whose value is derived from underlying assets such as stocks, bonds, commodities, currencies, interest rates and market indexes, and they play a crucial role in worldwide finance. The first edition of our Capital Markets: Derivatives guide is introduced by esteemed partner Carl E. Kennedy from Katten in New York and aims to provide a 360-degree understanding of these products, proving to be an informative tool for all those legal professionals who practice in the extremely complex business environment:? what derivatives are, how they are regulated, the trading documentation they require and the future developments in the field. The guide also covers recent developments in the derivatives market, including new products, technological innovations, and improved risk management of central counterparties (CCPs). Our guide will help uncover so much more besides the ISDAs, such as the agreements by the International Swaps and Derivatives Association that every derivative lawyer has learned to draft and be familiar with.

Employment 2024

Published on 5 September 2024

After an incredibly successful edition last year, we are delighted to announce the 2024 edition of this title, which will present essays on the recent changes in employment law from more than 50 international law firms. Introduced by Dr. Tobias Pusch from Push Wahlig Workplace Law, one of the leading employment law firms in Germany, this guide is what most of our editors consider to be one of our more interesting books to edit for the useful themes it explores, including equal pay, remote working, the role of unions, employment disputes and dispute resolution. The commentaries from our international contributors also give information on the latest regulations on contracts and conditions,? data privacy, the employment of foreign workers, and the legislation supporting a healthy work-life balance for workers. There is no doubt that thanks to modern technology and the needs of the workers in and out of the workplace, employment law is constantly faced with new challenges;? this guide intends to answer the most relevant questions in employment law in its participating countries, but it also a very 'relatable' manual that can be used as a reference by any practitioner working in this ever-evolving sector.

Child Relocation 2024

Published on 10 September 2024

When a marriage or other intimate relationship breaks down, one or both parties may want to make a change in their lives, for instance, by moving to another location, something that has become increasingly common. These actions will irremediably impact the lives of the family's children and will involve careful planning, compromise and consideration. Our popular title, Child Relocation, returned on 10 September to update us on the different rules relating to these issues per jurisdiction, including a description of EU regulations applied to member states and the UK post-Brexit. Around 40 law firms also supply information on the international legislation covering the potential risk of child abduction by one of the parents. The interesting articles in the guide highlight the difficult negotiating role of the legislators in this legal realm while they work out the best solution to please both the child, their biological parents and their carers; familiar topics such as foster care, adoption, relocation of minors and families with same-sex marriages are proposed, maintaining the focus fully on the primary needs and wishes of the child.

Commercial Gaming in the UAE: Key Legal Insights and Practical Processes

As the global gaming industry expands, the glitzy region of the United Arab Emirates is proving to be a key player in this dynamic sector, requiring an organisation to regulate commercial gaming in the region. The General Commercial Gaming Regulatory Authority (GCGRA) is an independent body of casino and gambling experts from the United States dedicated to establishing a robust regulatory framework that promotes the sector's growth in the UAE while ensuring player protection and guidance. Its purpose is to oversee any gambling activity (ie, where money is placed as a bet to win monetary prizes), including land-based gaming such as table games and slot machines, lotteries, sports wagering and internet gaming. It also instructs on how to set up and operate a commercial gaming business, how to apply for and obtain gaming licenses, and who the key parties involved in these operations are. This article, written by Karim Fawaz and Mirko Olmos of AX Law, presents an overview of the UAE's evolving gaming regulatory environment, indicating the GCGRA as the point of reference for those entities seeking to start commercial gaming activities in a territory where local religious beliefs forbid the practice, and where consequently gambling has always been illegal.

Wire and Cheque Fraud: An Ever-Growing Business Problem

Thanks to electronic banking, wire and cheque transactions allow us the easy and rapid processing of money transactions, but they can also be subject to different forms of theft, forgery and manipulation, which might potentially result in the loss of conspicuous capital for businesses in a matter of seconds. In this Chambers Expert Focus interview, counsel Travis Mock from Rakower Law PLLC provides an in-depth insight into the increasing threat posed by wire and cheque fraud and the steps businesses can take to protect themselves. In his video, Mock refers to the FBI's 2022 report, which recorded a high number of complaints related to wire fraud scams resulting in billions of dollars of losses. He also describes the new sophisticated processes used to obtain sensitive banking information (phishing, social engineering, SIM card swaps and 'cheque washing') that everybody working in a financial organisation will be familiar with and receive regular training for. The lawyer also lists the organisations that victims can contact to seek reimbursement and useful tips for organisations to reduce fraud and recover funds. This is an informative video that businesses and individuals will find incredibly useful in learning to safely use the net without falling into the fraudsters' net.

Global Labour Reforms in Focus: Key Takeaways from the G20 Labour Ministers’ Meeting

On the 25th and 26th of July this year, the beautiful city of Fortaleza in Brazil saw the gathering of key stakeholders at the Group of 20 (G20) Labour and Employment Ministers' Meeting to discuss current pressing employment concerns worldwide. In her article, lawyer Edith N Nordmann of ACG International, who was a guest at this special summit, comments on what was discussed; she informs us that particular focus was given to technology and recent market trends, but also fighting child and forced labour, promoting diversity and social mobility, filling the gender pay gap and eradicating poverty. The meeting also discussed the collaboration between Business 20 (B20), the official G20 dialogue forum within the global business community, and key international organisations to identify strategies for employers to tackle these issues and other emerging challenges. The text is a powerful piece that reinforces the responsibility of employers to prioritise these critical problems but also recommends that they maintain an ongoing dialogue with labour groups and other stakeholders to ensure tangible progress is reached globally within the employment industry.
