As the world is reminded of a new rise in energy costs, on 6 August we published our new Oil, Gas and the Transition to Renewables guide, which focuses primarily on traditional and recyclable fuels. Lately, the energy sector has seen a surge in mega-mergers of some companies to ensure a bigger position in the marketplace, although this has also attracted some scrutiny from governmental trade associations. Oil and gas are essential to our livelihood; energy is required for basic services like electricity, clean water, heating, cooking, medical care, and transportation, and it helps billions of people coming out of poverty. Its impact on our planet now demands we digress from conventional energy and invest in clean and renewable sources. This title will provide much clarification on all the fuels that nowadays are utilised not only to warm us and feed us but also to operate all the technology in the developing world, at a time when the demand for energy is higher than ever.

What’s new in Expert Focus
Streamlining the Self-Certification Requirement for Curbing Misleading Advertisements in India
It is universally known that advertisements - those clever media pieces devised by commercial companies to encourage us to purchase their products and services - can be misleading. In fact, adverts may occasionally carry inaccurate claims, falsely declaring to be associated with a product or a company or purposely omitting crucial information to hide some potentially compromising facts. The overwhelming volume of advertisements on digital platforms makes monitoring each ad in detail more difficult. In this article, partner Sayobani Basu and associate Ankitesh Ojha from AZB & Partners reveal how India has been witnessing the circulation of misleading advertisements lately, particularly in the health sector. To avoid this, they tell us that the Indian government has set up the Supreme Court Directive, which aims to address the proliferation of misleading promotion and protect consumers' fundamental right to health. In the article, the authors describe recent cases in which the SCD reprimanded some commercial exercises whose products promised to have genuinely extraordinary powers. Luckily, processes are now in place to ensure that advertisements are free of false information and comply with regulatory guidelines before they are published or broadcast, which is something that would not only prevent the purchase of a disappointing product but would also save its manufacturer from the grievous embarrassment to apologise for their deception at a national level.
What are the options when faced with employees in Japan who appear to be performing poorly?
Some working people might find it refreshing to learn how employment laws compare or differ according to employment jurisdiction. For instance, this video from partner Hideki Thurgood Kanoh of Anderson Mori & Tomotsune is a revelatory description of how, in Japan, the dismissal of employees with low performance is not as straightforward as we might think. According to Japanese law, we are told, there are first a few facts to establish before a legal termination might be considered, for example, a proven poor performance or if the employee has shown any progress following an improvement programme or an internal transfer within the company, which is seen as an opportunity for the worker to improve in an ideal role for them in the same organisation. Other solutions contemplated are termination and/or the offer of an agreed financial payout, although potentially risky or expensive for the company if the ex-worker starts legal proceedings. The author warns us that before termination is set in Japan, caution should be exercised, advising that it is best for both parties to agree peacefully on an agreement that can be satisfactory for all those involved.

As part of their Artificial Intelligence ChatRooms, an interesting series of conversational videos on the evolving landscape of the legislation surrounding AI, DLA Piper presents a video on AI's impact in the digital medicine field. In this video, lawyers Danny Tobey, Keo Shaw, and Kristi Kung exchange opinions on the potential of AI in improving patient care and what health agencies are doing to keep up with these rapidly evolving technologies. AI, they tell us, is being increasingly used in behavioural health treatments like virtual reality simulations for phobias, clinical trials, and individually tailored treatments for patients; it can also effectively identify errors when they are made. The rapid pace of technological change however poses a constant challenge to the clinical validation of AI; while it will be essential to train doctors on how to critically evaluate AI tools, there will also be an imperative need for clinicians and practitioners to collaborate to draft clear policies for the safe, ethical and transparent use of this innovative technology in healthcare, which will certainly cause significant advances in the medical field.
