The Certificate of Inventorship

The Certificate of Inventorship

The Certificate of Inventorship

In the world of patent law, honouring inventors is fundamental to recognizing the visionary minds behind revolutionary inventions. In Indian scenario, typically, patent certificates issued by the Indian Patent Office (IPO) prominently showcase the names of the applicant(s) who have sought patent protection. However, a significant gap has been revealed that is related to the lack of acknowledgment for the inventors themselves.

In response to this oversight, recent amendments to the Patent Act 1970 have initiated a transformative change. The introduction of Rule 70A empowers inventors by enabling the inclusion of their names on patent certificates through the Certificate of Inventorship. Rule 70A stipulates that the Controller may issue a certificate of inventorship to an inventor in respect of a patent in force. To commence this process, the inventor must submit a request in Form 8A. Notably, the fee for e-filing by a natural person, startup, small entity, or educational institution is Rs. 900.00, whereas for physical filing, it is Rs. 1,000.00.

The availability of the Certificate of Inventorship presents an extraordinary opportunity to honour the inventors whose brilliance and creativity drive invention forward. By showcasing their names alongside the patent details, inventors not only affirm their rightful recognition but also commemorate their invaluable contributions to the intellectual landscape.

At AM Legal Associates, we are committed to supporting inventors who seek to issue a Certificate of Inventorship for their contributions to patented innovations. 1) "Notably, the fee for e-filing by a natural person, startup, small entity, or educational institution is Rs. 900.00, whereas for physical filing, it is Rs. 1,000.00." Form 8A needs to be filed by the Inventor and not by startup, small entity, or educational institution. 2) If you see the "form of patent" in the third schedule, a patent certificate shall include the name of the inventors. But actually, the patent certificate does not.
