Be Cautious As Though You Do Not Have Insurance

In the previous weeks, an attempt has been made in my write-ups to establish that insureds are required to take all reasonable steps to protect themselves, their insured properties, activities, and operations as if they do not have insurance. Doing this will result in a win-win situation for both the insurance company and the insured in terms of reduced insurance claims for the insurance company and reduced premiums for the insured.

Take a look at some circumstances under which an insurance claim would not be admitted by an insurance company in relation to moral and physical hazards. Kindly bear in mind that the majority of the circumstances listed below relate to insurance of the person, property insurance, and liability insurance:

? If an insured vehicle is used in an unsafe or un-roadworthy condition and such condition caused or contributed to the loss

? Further damage or extension of damage if an insured vehicle is driven after an accident before the necessary repairs are carried out

? If an insured vehicle is sent to a workshop or garage for repairs

? Loss or liability incurred whilst an insured vehicle is on a railway line crossing, whether running or stationery other than as cargo

? If an insured vehicle is being used or attached to or towing a vehicle being used for commercial transportation of dangerous goods by road or rail unless it complies with the legal and safety requirements for the transportation of dangerous goods by road or rail

? Engaging in or practicing for speed or time trails, and racing of any kind or participating in overland expeditions or any hazardous sports, or pursuits or activities unless declared to and accepted by the insurance company

? Scuba-diving to depths greater than 30 meters, solo diving, cave diving, diving for hire or reward, flying within 24 hours of last dive, diving whilst suffering from a cold, influenza or obstruction of the sinuses and/or ears, diving by persons aged under 12 or over 60, diving without holding a recognized certificate for the type of diving being undertaken or not under professional instruction or diving without proper equipment and/or contrary to codes of good practice

? Engaging in big game hunting, underwater diving using artificial lung navigation in international waters in craft not intended for the public transport of passengers, horse riding, climbing, pot holing, boxing, wrestling in any of its modes, martial arts, parachuting, hot air ballooning, free falling, gliding and, in general, any sports or recreational activity that is notoriously dangerous

? Participating in competitions or tournaments organized by sporting federations or similar organizations

? Engaging in skiing and/or similar sports, winter and or/summer hazardous sports

? Loss or damage arising from flight delay, detention, seizure or confiscation by customs or other officials

? Loss of personal effects or luggage left unattended by the insured person unless in locked accommodation
